The other two million I would use to start a scholarship foundation in the name of my beloved grandfather who took good care of me when I was little and in need of a father image. The remaining one million I would be something like my discretionary fund, ready for small donation to any worthy cause that I might come across during my lifetime. The money is not something that I will allow to rule my life. Rather, I will make sure to enjoy the money that I set aside for myself while I use the rest of it to make a difference in this world. I would definitely make a career change for myself because then I could help other people by providing them with jobs that are badly needed in our economy today. That is the lesson that I learned from Bill Gates and the way he handles his billions and that is how I shall use the money as well. Money can either turn a person evil or kind, I will choose to be kind and humanitarian in every way that I can

Regulation and Criminal Liability Essay Example for Free
Regulation and Criminal Liability Essay Currently in the United States, the Americans continue to face unfair treatments of health care professionals within the work place. Regulates and laws have been created and set forth to help individualsââ¬â¢ feel protected and to know their rights as a victim of such criminal acts. People deserve to be treated with respect, especially in the care of health professionals. In this paper will contain information on criminal liabilities of health professionals and show people who may have been violated by health care providers the steps of filing a civil complaint. In addition, the paper will go into investigating allegations and disciplinary actions. Up-to-date regulatory policy regarding health care professionals is based on the speculation that the market for resources in health care is unsuccessful because consumers do not have complete facts about the nature of services these professionals offer. The outcome of some professionals possibly will exploit consumers on the condition lesser-quality services. The theory of economics proposes that in the absence of order, many health care professionals might offer minimum quality services at expensive quality prices to uneducated consumers. Therefore, the main justification for managing health professionals is to expand the quality of their services and to guard the interests of unaware health care consumers. Health care professional guidelines restrict access into the profession by setting the least possible measures of education and experience mandatory to practice. Furthermore, those regulations identify the legal acceptable boundaries of training for the health care provider or the permissible scope of health care professionals training and state the permitted business training of health care professionals. In the United States the federal system of government, regulates every states health care professional practice. Health professional training performances are statutory laws that create regulatory or licensing agencies or boarding to promote rules that order medicalà practice. State licensing laws initiating the lesser level of education and experience needed to practice, explain the roles of the profession and bound the act of these roles to licensed individuals. State occupation practice limits restrictions on the services of professionals by for-profit firms, limitations on the operation of trade names, restrictions on the process of numerous workplaces, and boundaries on the place of health care professionals workplaces. Earlier in 1977 state companies practice limitations on frequently incorporated restrictions on marketing by professionals. Principles of Medical Ethics, the American Medical Association (AMA) declare a physician shall obey the lawâ⬠and ââ¬Å"record doctorsââ¬â¢ insufficient in character or ability, or engaging in deception or fraud. AMA could refuse membership to doctors guilty of criminal activity, in addition to physicians charged with crimes in different countries. Reference to petition for licensure, the Federation of State Medical Boards, in connection of state medical boardsââ¬â¢ responsibility for punishing physicians, suggests that every state medical board run criminal record review as part of licensure application practice and all candidates with a criminal background, comes before the committee for questioning to examine the candidates ability for licensure. AMA recognizes that doctors can be criminally arraigned merely to the degree of statue, and these regulations unlike state to state. Although illustrations from our data demonstrate the regular ordinary sanctions by state medical boards after the doctors have been criminally found guilty. According to AMA recent data less than 80 percent of doctors who carried out sexual acts offenses the physiciansââ¬â¢ licenses would be revoked, suspended, or surrendered. Merely 53 % of doctors convicted of criminally possessing, using, or prescribing controlled substances and only 40% of doctors were guilty of criminal wrongdoing connected to the practice of medicine had their licenses surrendered, revoked, or suspended. The statistics show a system that permits questionable physicians to remain practicing medicine after displaying clear unethical and risky behavior. Sentimental Wedding Speech from the Father of the Bride -- Wedding Toa
Sentimental Wedding Speech from the Father of the Bride This speech uses quotes that are skillfully woven into his more personal message, which is a good way of adding humor and providing the speaker with material that is neither offensive or dull. He also includes several jokes that are popular in wedding speeches, but has given his own twist on them to add originality Ladies and gentlemen, may I start my speech by welcoming the guests. Today, we are surrounded by most of the friends and family that have been important to us during our lives. Some have traveled thousands of miles, just to be here today. We welcome you all and thank you sincerely for sharing this special day with us. As about half of you will know, this is my second father of the bride speech. To misquote Oscar Wilde from 'The Importance of Being Ernest: ââ¬Å"To lose one daughter may be considered unlucky. to lose two is careless!â⬠Well. I guess that's O.K. because my being careless is how they came to be here in the first place. Making the father of the bride speech, I feel a bit like a Sheik walking into his harem for the first time. I know what I've got to do, I just don't know where to start. You will all be pleased to learn that my speech will be every bit as good as last time. In fact, my side of the family will probably remember great chunks of it. Not really, although I am following exactly the same format. This means it will probably start off badly, sag in the middle with long silences, and then trail off into a lot of incoherent rambling. To be honest, I did try to memorize this speech, but forgive me if I resort to my notes every five seconds. I asked for an autocue to be set up in front of me. Apparently, the wedding budget doesn't str... ...qually as long -and I haven't quite finished yet because my next toast is to the bride and groom. That reminds me of the wedding I once went to where the two of the guests were a minister and a priest. When the priest was offered a drink for the toast he said ââ¬Å"Iââ¬â¢l1 have a large whisky please." When the minister was offered the same, he said "No thanks. I'd rather go with a scarlet woman than touch the demon alcohol." The priest promptly put his whisky back on the tray and said ââ¬Å"I didn't know there was a choice.â⬠Now I don't want to offend anybody, so if theres a priest or a minister present, I apologize. And if there's a scarlet woman here, Iââ¬â¢11 meet you in the bar in ten minutes. Thank you for your indulgence. Without further delay I'l1 ask you to join me in a toast to my beautiful daughter, the bride, and her handsome husband, the groom. The bride and groom.

The Partridge Family :: essays research papers
If you were alive 30 years ago you probably can recall those Friday nights when you were sitting in front of the television set during prime time watching a widowed mother and her five children who charmed America and broke a generation gap with their groovy, bubble gum sounding tunes. You probably would also know that "The Partridge Family," with its something for everyone cast and groovy tunes, took over America as an instant success in the fall of 1970.The Partridge Family was the 70s successor to the Monkees who were a mid 60s hit. Both the Monkees and the Partridge Family were fictional rock/pop bands produced by a television branch of Columbia Pictures called Screen Gems, but unlike the Monkees, the Partridge Family strictly was about wholesome and traditional family values. (UBL.com)The famous cast included screen and stage veteran Shirley Jones who played the mother, Shirley Partridge. Shirley Jones had been in numerous plays and movies including Rodgers and Hammerstienââ¬â¢s "Oklahoma!", "The Music Man", "The Big Slide", and the 1960 film version of Elmer Gantry which won her an Academy Award for her role as a prostitute. In 1956, Shirley Jones married actor Jack Cassidy who was the father of her future co-star David Cassidy. Born April 12, 1950 in New York City, David Cassidy grew up in the show business atmosphere with both his father and mother being avid performers. After he graduated from Rexford, a private school in Beverly Hills, he worked with the Los Angeles Theater Group and was featured in the Los Angeles theater production of "And so to Bed" (members.tripod.com). After that he moved to New York and back to Los Angeles while starring in several plays and TV shows including "Mod Squad" and "Bonanza", but David Cassidy didnââ¬â¢t get his big break until he returned to his first love, music, when he was cast as Keith Partridge. Other cast members who played Partridge siblings included Susan Dey, a popular New York fashion model who played Laurie Partridge, and the red headed and freckled Danny Bonaduce who played Danny Partridge and to many peopleââ¬â¢s surprise actually came from an 100 percent Italian background (The Partridge Family Deluxe Souvenir Album). The youngest partridges as you may know were Chris and Tracy. Chris was first played by Jeremy Gelbwaks during the first season, but his parents soon became uncomfortable about his acting with the mania that surrounded the show and took their son out of the cast.

The Vicious Cycle of Broken Homes and Unsuccessful Marriages
Children from broken homes become disenchanted with the idea of marriage. When they grow up, they come to distrust its role as a social institution and look at it lightly. According to statistics, a high percentage of people from broken homes end up with unsuccessful marriages (Rossi, 1990, p. 246). Research on broken homes show the overwhelming negative impact of broken homes on the psychological health of children. Studies show, for example, that delinquency is related to broken families.Parental neglect plays a part in the frequency of delinquency among females, particularly when this neglect results from a broken home . Children from broken homes are also more likely to develop attention deficit disorders than children from normal families. They tend to suffer more damaging mental problems that influence them to make incorrect decisions in life (Rossi, 1990, p. 247). These children could sustain these psychological problems in their early adulthood, making them unfit to handle re sponsibilities in a marriage setting (Coleman, 1976, p. 389).Other studies show that children from broken homes are more likely to have sex before the age of 16. Itââ¬â¢s been shown that the adolescent mind is not developed enough to make strong life decisions. If children are pushed to marry because of unwanted pregnancies, then the resulting marriage is more in danger of falling apart. As children in broken homes become more and more distrustful of marriage and sustain more psychological trauma, broken marriages unsuccessful marriages form a vicious cycle that leaves everyone a victim. Early intervention is needed to correct childrenââ¬â¢s view of marriage and themselves. However, this is not easy to do as research also shows that broken homes lead to educational difficulties in children. People from broken families must seek counseling to strengthen their marriages. Education plays a vital role in stopping this vicious cycle, but it must be done early and regularly through t he victimsââ¬â¢ lives. References Coleman, J. C. (1976). How to Ace the SAT 6 Expert Tips and Strategies
How to Ace the SAT 6 Expert Tips and Strategies SAT / ACT Prep Online Guides and Tips If you want a top SAT score, you need more than a desire to succeed. Determination and hard work are two vital ingredients for acing the SAT, but also you need to use effective study strategies to help you reach your goal. I've helped hundreds of students prepare for the SAT, and I know the best methods to utilize to conquer this exam. In this article, I'll explain exactly howto ace the SAT, includinghow long you need to study, the best SAT prep strategies, and key test-taking tips. What Is Acing the SAT? For the purposes of this article, acing the SAT refers to getting a score over a 1400. Getting this score will make you competitive for admission to the vast majority of colleges, and based on past results, if you get a score higher than 1400, youââ¬â¢ll likely score better than 95% of students who take the SAT. To get this score, youââ¬â¢ll only be able to miss a handful of questions on each section. However, for the most selective colleges, you may need a score of 1550 or higher for your SAT score to help your chances of getting in. Depending on your college goals, figure out your target score and what a good score would be for you. Regardless of whether youââ¬â¢re aiming for a 1400 or a 1600, if you follow the advice in this article, youââ¬â¢ll be on the path to success. If youââ¬â¢re striving for a 1000-1300, you may want to focus on our posts about improving your Math, Reading, and Writing scores. How Long Do You Need to Study to Ace the SAT? Often, this is one of the first questions students want to know. Primarily, the answer depends on your starting point and your target score. How much you need to improve will determine how much you need to study to achieve your goal. If you havenââ¬â¢t taken the SAT yet, take an official practice test simulating real testing conditions to determine where youââ¬â¢re at and how much you need to improve. Hereââ¬â¢s a rough estimate of how long youââ¬â¢ll have to study based on how many points you need to reach your goal: 0-30 point improvement: 10 hours 30-70 point improvement: 20 hours 70-130 point improvement: 40 hours 130-200 point improvement: 80 hours 200-330 point improvement: 150 hours + Know how long you need to study. Acing the SAT: Best Ways to Study You donââ¬â¢t just need to put in the necessary hours to ace the SAT; you need to study efficiently. Regardless of whether youââ¬â¢re using test prep books, you have a tutor, or you take an SAT prep class, you should be incorporating these practices into your SAT studying. #1: Use Official Practice Questions The best questions to study from are those that will most closely resemble the questions that appear on the SAT. The SAT is unlike tests you've taken in school, and its format is unique. The more comfortable you get with correctly answering the types of questions that will be on the SAT, the better you're likely to do on the test. A huge flaw of many test prep books is that their practice questions are either much harder or much easier than those youââ¬â¢ll find on the SAT. Also, some books present questions in a different format than that of the SAT. Instead of relying on those sources to prepare, you should focus on studying with official practice problems. The best study resources are official practice tests provided by the College Board. Also, Khan Academy has partnered with the College Board and provides additional official practice questions. Furthermore, the official PSAT practice test has quality practice questions. If youââ¬â¢re looking for an online prep program, the PrepScholar SAT prep program has thousands of realistic practice questions created by SAT experts. Use real SAT questions in your prep. Want to learn more about the SAT but tired of reading blog articles? Then you'll love our free, SAT prep livestreams. Designed and led by PrepScholar SAT experts, these live video events are a great resource for students and parents looking to learn more about the SAT and SAT prep. Click on the button below to register for one of our livestreams today! #2: Focus on Your Weaknesses and Analyze Your Mistakes Youââ¬â¢ll make the best use of your study time by focusing on why youââ¬â¢re missing questions and trying to improve your weaknesses. If you just do a ton of practice questions, but you donââ¬â¢t stop to figure out why youââ¬â¢re getting questions wrong, your score wonââ¬â¢t improve much. If you want to ace the SAT, youââ¬â¢ll have little room for error. Youââ¬â¢ll want to understand every type of question and be able to finish each section in the allotted time. For every practice test or question set you do, mark each question that youââ¬â¢re even 20% unsure about. Then, when youââ¬â¢re reviewing, thoroughly examine each question you got incorrect or guessed on. Make sure you understand how to correctly answer the question and what you didnââ¬â¢t grasp or did wrong. Keep track of all of these questions with specific notes about what you need to improve. Figure out exactly why you got questions wrong. Be as specific as possible. These are the major areas you might need to improve. Content Again, to ace the SAT, you need to thoroughly understand all of the common topics that are tested on the SAT. The SAT tests you on a number of concepts related to reading, writing, and math. By identifying the specific types of questions you get wrong, you can identify the topics you need to learn better. For example, on Math, you may notice that youââ¬â¢re missing questions related to quadratic functions. On Writing, you may be having difficulty with questions that deal with sentence and paragraph order. Once you diagnose your content weaknesses, study the content. We have articles on this blog related to every type of question. Once youââ¬â¢ve become more familiar with the content, do a ton of related practice questions and understand how to correctly answer each practice question. Know where you're weak. Time Even if you understand SAT content and how to do each question, you may struggle finishing sections in the allotted time. If you're finishing sections with more than five minutes remaining and making careless mistakes, then you're rushing. If youââ¬â¢re rushing, all you may have to do is slow down and read the questions more carefully. If youââ¬â¢re having trouble finishing questions on time, monitor your time spent per question during your practice. Also, you may increase your speed as you improve your content knowledge. Finally, you may be able to better your time management by adopting quality test-taking strategies. For Reading and Writing, you need to figure out the most efficient way for you to read the passages to maximize your score. Drill your approach in your test prep so that youââ¬â¢re comfortable with it. For Math, memorize all formulas you may need to know. Strategy Some students are comfortable with the content and donââ¬â¢t have issues with time management, but theyââ¬â¢re still missing questions. Usually, this occurs because of a lack of understanding of SAT strategy. If you succumb to common SAT tricks, then you likely need to improve your knowledge of SAT strategy. For example, if you know the grammar rules that are tested on SAT Writing but youââ¬â¢re missing questions because youââ¬â¢re not reading the whole sentence, you need to work on your SAT strategy. Strategy errors occur when you understand the content thatââ¬â¢s being tested, but you need to improve your approach or understanding of the questions. Acing the SAT: Top Test-Taking Tips Following these tips will help you avoid strategy errors and enable you to correctly answer questions more quickly and efficiently. Make sure to use these tips when taking practice tests so they become a regular habit for you. #1: Answer Every Question Before the redesigned SAT was introduced in March 2016, incorrect answers were penalized. Now, there's no penalty for incorrect answers, so it's in your best interest to answer every single question. Even if you have no clue, you should guess, since you have a 25% chance of randomly picking the correct answer on the multiple choice questions. This is also why it's important to have good time management to ensure that you're able to complete each section and have an opportunity to answer all of the questions. If you're running out of time and know you won't get to the end of the section, you should still fill in random bubbles to give yourself a chance at getting extra right answers. #2: Underline Key Words in the Questions Regardless of the section, underlining key words can help you make sure you know what the question is asking and avoid careless mistakes. For example, in Math, you can check to see if you should be solving for x or y. In Writing, you can ensure if a question is asking you whether a sentence should be added or deleted. #3: Eliminate Wrong Answers While this strategy may sound obvious, itââ¬â¢s important to use, especially if youââ¬â¢re not immediately 100% certain of the right answer. In Reading and Writing, there may be answer choices that seem plausible, but if anything about the answer choice isnââ¬â¢t correct, it must be eliminated. Similarly, in Math, if you have a rough estimate of the correct answer, you can eliminate any answer that isnââ¬â¢t close to your estimate. Or if you know the answer is positive, you can eliminate any answer thatââ¬â¢s a negative number. Eliminating wrong answers will increase your chances of getting questions right and help you arrive at the correct answer. #4: Finish With Extra Time to Recheck Your Work You should try to finish each section with roughly 5 minutes remaining. During the remaining time, check any questions you were unsure of. I recommend marking any questions youââ¬â¢re uncertain about while youââ¬â¢re taking the test. Double check how you got your answer. Once you feel confident in your answer, go to the next question. If youââ¬â¢re still unsure, stick with your initial guess and go to the next question. After looking over questions you were unsure of, check that you did all your bubbling correctly. Inspect your answers Final Advice: How to Ace the SAT Acing the SAT isnââ¬â¢t easy, but itââ¬â¢s possible with enough diligence and a good plan. Mikhail was promoted to the status of General Secretary. He had a vision of what to do to sustain communism in Russia making him to initiate a programme known as ââ¬Å"Perestroikaâ⬠targeted at assisting the rebuilding of government and military but the main aim was to facilitate Soviet living standard.Perestroica however turned out to be a failure. The year 1991 witnessed a sharp worsening of economy before the eyes of Gorberchev and he was helpless. Thereafter, the USSR voted out of reality in Dec 1991 and Gorbachev quitted as president of the former Soviet Union. Finally, communism destroyed the soviet empire. The bug of communism finally demised the last bit of energy from Russian nation in the period of 1980ââ¬â¢s and 1990ââ¬â¢s leading to the disintegration and demise of the Soviet Union. In conclusion, one of the major reasons for the demise of the communism is that the government failed to measure up to standard in her promise for a better quality of life to people Another factor is the failure of the government to properly handle both social and foreign affairs. The Challenge facing Russia now is the responsibility and a task that may be impractical, a voyage that may take many years. However it is believed that in the nearest future, Russia may regain a stable and well-balanced government.

Civil Disobedence Essays - Civil Disobedience, Nonviolence
Civil Disobedence Essays - Civil Disobedience, Nonviolence Civil Disobedence Throughout the history of the United States, there have been many times when citizens have felt the need to revolt against their government. Such cases of revolt took place during the times Henry David Thoreau. The reason for his revolution included discrimination against the community and Americans refusing to pay poll taxes to support the Mexican War. Thoreau used civil disobedience to change people's ideas and beliefs to stop the injustice brought against them and their nation. Civil Disobedience is defined as refusal to obey civil laws or decrees, which usually takes the form of direct action (Grolier's Encyclopedia Online). People practicing civil disobedience break a law because they consider the law unjust. They want to call attention to its injustice, hoping to bring about its withdrawal. Thoreau wrote Civil Disobedience in 1849, right after spending a night in the Walden town jail for refusing to pay a poll tax for the Mexican War. He recommended using direct action to create social tension, thus leading to the reform of unjust laws practiced by the government. He voiced civil disobedience as, An expression of the individual's liberty to create change (Thoreau). Thoreau felt that the government had established order that resisted reform and change. Action from principle, the perception and performance of right, changes things and relations; it is essentially revolutionary (Thoreau). Thoreau refused to pay the poll tax because the money was being used to finance the Mexican War. Not only was Thoreau against the war itself, but the war was over Texas, which was to be used as a slave state. His friend, Staples, offered to pay the tax for him, but to Thoreau, it wasn't paying the tax that he was objecting to, it was how the money would be used. Thoreau felt strongly about paying money toward a war he did not support. He would rather end up in jail than go against his will. Your money is your life, why should I haste to give it my money (Thoreau). This illustrates how strongly he felt. It was very important to Thoreau to inform the public about the war. He wanted people to realize why it was wrong to support it. Thoreau never rallied hundreds and thousands of people together, violently or nonviolently, to get reactions. Instead, he went to jail to protest and wrote his essay, Civil Disobedience. Thoreau's philosophy was to get people to think and take their own approach to a situation. Thoreau definitely had many of the ideas of how to deal with unjust laws performed by government. Thoreau inspired reform and also overturned many unjust laws and customs in our country. We, as a society, should look at this man as heroic figures and learn from his teachings. This will help us better our knowledge of how to use non-violent direct action for future national and international problems we may encounter.

Cathy Whitaker is a rich woman who happens to be living in a marriage that has no happiness and no sexual fulfillment, until she comes to learn very late that her husband, Frank, was also a gay (Haynes, n.p.). In the course of her stressed life, Cathy Whitaker happens to come across Raymond Deagan, who is the son of her former gardener who is already dead (Haynes, n.p.). Due to the unfulfilling marriage that Cathy Whitaker lives in, she develops passionate feelings towards Raymond, which eventually turns into love feelings that see both establish an intimate relationship. However, considering that Cathy Whitaker is a rich woman who is courting Raymond; a black and poor man, the society applies its social biases and prejudices against the black race and against the relationship between the rich and the poor, to ev entually separate the two. Three white boys abuses Raymondââ¬â¢s daughter, causing Raymond to decide never to engage with a white woman again (Haynes, n.p.). The whole neighborhood is also spreading word about the unethical relationship between Cathy Whitaker, a married woman, and a black poor man, causing Cathy Whitaker to be the laughing stock of the whole neighborhood. The same script is repeated in the film Ali: Fear Eats the Soul (1974), where Emmi, a German widow in her 60s gets engaged with a

Flood Prevention and Lessons Learned (Cedar Rapids Iowa Flood of 2008) Essay
Flood Prevention and Lessons Learned (Cedar Rapids Iowa Flood of 2008) - Essay Example The floods which were experienced in 2008 in the city of Iowa caused massive damage, farmlands were destroyed businesses were demolished all major social amenities were almost taken to ground and thousands of people who were living in Iowa were left homeless. Millions of dollarsââ¬â¢ worth of property was destroyed and lead to the lives being lost and livelihoods being shattered. Floods were later to be categorized as the Fifth major disaster that has ever occurred in the United States and the first in the city of Iowa (Nazoom, 58). When it comes to comparison and categorizing, it takes one back to the flood stories. While giving a comparison between the two floods stories namely the Old Testament and Gilgamesh epic, one gets a great an impression that there are similar occurrences. For some scholars, the similar elements between the two flood stories become perplexing. There are possible things with the two accounts shown by Alexander Heidel. These possibilities are that the Hebr ew story came first then the Babylonian story followed thus copied from the previous. The Hebrew story could therefore have borrowed the ideas from the Babylonians and both stories descended from the common original story of Noah. Since many people are conversant with the original story in the Old Testament, they forget to research on how the genesis story resembles the flood story of Gilgamesh (Sanders, 2003). The two stories are so alike with the main theme of forgiveness being the domineering similarity between the two. The two stories however differ in the events that took place during the floods, which for many seem to be the small details. In the two flood stories, the numbers of event days differ regardless of the basic events taking place in very different ages. Focusing on the flood stories for a minute, It is before 2000 B.C that Gilgamesh flood story got the first publishing while the Old Testament story was in 400 B.C, which came much later than the Gilgamesh flood (Sand ers, 2003). In both stories, God or gods gets annoyed and the Old Testament clearly shows how those who did not follow the correct ways he wanted them to follow annoyed God. The other difference is that there are worshiped gods or God as well as heroes like Noah during this period. When the Gilgamesh story takes place, gods allow existence of half-god and half-human on earth. The other similarity is the number of people saved and the reasons behind the saving after the floods. Having looked at both stories carefully, there is a good man like Noah in the Old Testament and Utnapishtim from Gilgamesh, saved and chosen by either God or gods (Nazoomi, 2005). In the two stories, both men choose to send birds to find the dry land. Both Noah and Utnapishtim are rewarded because they show proper reverence to their gods. Years after the floods in Cedar Rapids took place, the people and the leadership of that area is still trying to recover from the damage that the floods caused their sufferin g. Different policies have been developed since of which some have been accepted and others criticized or rejected. The United States Government offered the City of Cedar Rapids 2 million Dollars to help them after the devastations, but what was actually incurred by the floods was 5Million dollars worth of damages. What it actually meant was that the remaining amount in which the Government did not provide, the people of
Case 2.2 Gucci America, Inc. V. Wang Huoqing Assignment
Case 2.2 Gucci America, Inc. V. Wang Huoqing - Assignment Example It can be derived from the report and the previous research conducted on the topic that products of Gucci America were highly recognized and its trademark valuable. For this reason, Wang Huoqing created products that resembled products from Gucci. The main dispute was caused by infringement of trademark rules. This is because Wang Huoqing used the Gucci trademark for its products. Upon realization, Gucci America filed a case aimed at challenging the legality of the trademark on products used by Wang Huoqing. The researcher states that the legal question raised may be valid. Upon registration, Gucci America was provided with the right to regulate the use of its trademark. The defendant breached this legal agreement by using the trademark without the authorization on the plaintiff. This essay discusses that the decision by the courts is that Wang Huoqing did not adhere to the trademark requirements. In addition, the courts reached the decision that the dependent was liable to pay compe nsation to the plaintiff. In addition, the questions raised by the plaintiff on the harm made on the Gucci America brand were sustained. The author has rightly presented that the argument prior to the decision is that Gucci America was the first organization to be provided with the right on the Gucci Trademark. Another organization may use the trademark after an agreement with the parent company.Ã Ã

Needs and Wants in American Society Essay Example | Topics and Well Written Essays - 750 words
Needs and Wants in American Society - Essay Example One reason why there seems to be a discrepancy in the definition of need in American society is that people do not seem to care even if such a so-called ââ¬Å"needâ⬠would actually ââ¬Å"[reach] the point of being physically harmfulâ⬠(Sowell 189). One would basically whine that he ââ¬Å"needsâ⬠more chocolate although he has just consumed five bars of Mars in an hour. Perhaps, for a lack of a more appropriate word or for some problem with semantics, the English language would simply let us use the word ââ¬Å"needâ⬠for anything that we want including desires, cravings and addictions. Indeed, Americans have ââ¬Å"an addiction to consumptionâ⬠that may even qualify as a ââ¬Å"sicknessâ⬠(Quindlen 508). This ââ¬Å"sicknessâ⬠is more like a neurosis about having the latest Marc Jacobs bag, or a paranoia about not having an iPhone 5. The phrase ââ¬Å"I need somethingâ⬠can now therefore be replaced with ââ¬Å"I am paranoid about thisâ⬠or simply ââ¬Å"I am sick.â⬠Moreover, part of this sickening addiction to consumption which American consumers conveniently call ââ¬Å"needâ⬠is the idea of overusing credit. ... American consumer continues to rationalize, what he believes he ââ¬Å"needsâ⬠are actually only his ââ¬Å"wants.â⬠Second, there is a problem with how the word ââ¬Å"needâ⬠is defined because American consumers do not seem to recognize the idea behind trade-offs. Understanding and doing a trade-off is simply a making that small sacrifice of giving up the purchase of one thing considered to have an advantage for another which is actually truly desirable. The problem with the average American consumer nowadays is that he does not realize that ââ¬Å"at other prices [he] can get along with what [he has]â⬠(Sowell 190). A huge factor in this lack of ability or responsibility to do trade-offs is the addiction caused by the media, but an equally great factor is the laziness on the part of the consumer in filtering out various product information from the media. Consumers who do not think will naturally adopt the ââ¬Å"acquisition habits of a 7-year-oldâ⬠and a 7-year-old definitely has the faintest idea of what a ââ¬Å"needââ¬â¢ is (Quindlen 509). One can therefore not expect that a 7-year-old has any idea about good trade-offs. Naturally, if all consumers were of this age, then tons of useless ââ¬Å"triflesâ⬠would replace good and useful products that could have resulted from sensible trade-offs (509). In short, those who perpetuate the misuse of the word ââ¬Å"needâ⬠are actually those who not only believe that ââ¬Å"Marc Jacobs is Godâ⬠but especially those who have not realized that ââ¬Å"stuff does not bring about salvationâ⬠(509). If one considers shopping and consumption as religion, then it follows that he is very much willing to heed its gospel and even do everything to attain enlightenment and salvation with it. Anything proclaimed by this gospel as important is therefore merely a
Does My Generation Have a Role in America's Future Essay
Does My Generation Have a Role in America's Future - Essay Example I believe that my generation has a role to play in Americaââ¬â¢s future. My generation has a role to play in Americaââ¬â¢s future in the sense that it is a generation which continues to engage itself in new technology and innovations which make life easier for millions of Americans. We are a generation which continues to explore the latest technologies ââ¬â technologies ââ¬â which make tasks easier and more efficient to undertake (BBC News, 2). These technologies also make tasks faster and less energy consuming. Considering the fact that production lines often take up more of our natural resources on a daily basis, technological innovations which consume less energy and which accomplish tasks efficiently are important novelties in securing a sustainable future. We have a role to play in Americaââ¬â¢s future because we, more than any other generation, have a greater affinity to these technologies (BBC News, 2-3). We understand its usage more than our older counterpart s, and we are eager to embrace these technologies and their implications in our daily activities. Moreover, we are eager to learn more and explore more of these technologies and to consider where they can take us (BBC News, 2-4). These technological innovations also come in the form of digital technology. I have a role in Americaââ¬â¢s future because further developments in digital technology will be continuously introduced in our society (vanââ¬â¢tHooft, p. 2). This digital technology will be easier for us to utilize because, from our earliest years in the academe, this technology will be used as medium of instruction. Digital technology will become a major part of our life and our primary means of conducting transactions, business, and other activities. The older generation would likely be having a more difficult time adjusting to the use of digital

Comparison between Management Information System (MIS) and Executive Essay
Comparison between Management Information System (MIS) and Executive Information System (EIS) - Essay Example In the banking industry, such systems find tremendous use as they are employed for various activities like financial reporting, analysis, capital investment decisions, investment risk analysis and cash flow analysis. All these activities require executive overview as well as managerial decisions at different levels, which require the use of either EIS or MIS as deemed necessary. Specifically speaking, the project will analyze the utilities of these systems for senior and middle management in the target industry, who use the services of these mediums for business planning, forecasting, monitoring and control. Further, the significance of these systems amongst various departments within companies as well as their specific uses by employees for realizing various tasks will be studied thoroughly. As mentioned above, the primary purpose of the project is to provide a critical comparison between the use of Management Information Systems (MIS) and Executive Information Systems (EIS) in the investment banking and financial sector. For this purpose, an elaborate study will be undertaken to analyze such systems used in prominent investment banks in the United States like Bank of America, Citigroup, Morgan Stanley and Goldman Sachs. In this study, a number of objectives have been outlined which will be evaluated to provide an extensive comparison amongst the two chosen categories. These objectives are listed below. As the name implies, Information systems serve the primary purpose of information gathering, processing and appropriate display. In doing so, the worthiness of both MIS and EIS will be evaluated for their efficiency in processing information without much processing and user involvement. This is especially essential for users in specific departments as relieving them from additional processing provides them the much needed time for elaborate decision making using the information provided by these systems. Air Asias Corporate and Business Strategies
Air Asias Corporate and Business Strategies Air Asia is a low cost air carrier that charges the lowest fares per kilometre in the world. A PESTLE analysis indicated that liberalisation of the air market has improved international market access and supported the growth in the number of airlines and passengers in East Asia. A five forces analysis indicates that the airline industry is highly competitive, with a high threat of new entries and of substitutes in the domestic travel market. Air Asia is positioned at the low cost end of the spectrum of competitors that fly internationally. A SWOT analysis indicated that Air Asia has strengths in management, operational efficiency and marketing, but has weaknesses in staffing, customer care, and attractiveness to business travellers. The airline has been successful because it has taken an entrepreneurial and innovative approach to the market, leveraging its competencies to create automated ticketing processes and to reduce other operational costs. The airline should consider expanding into Europe and western Asia using Abu Dhabi as a hub, which would require additional aircraft or joint ventures with other low cost carriers. The firm should also consider introducing business class flights that charge a higher price, but provide the services including convenient scheduling that can attract the business segment of the airline market in East Asia. 1.0 Introduction Air Asia is a low-cost air carrier providing service between its main hub in Kuala Lampur, Malaysia and destinations in East Asia. The airline also provides service to Abu Dhabi and London. Air Asia has adopted a generic strategy of cost leadership by reducing the cost of operations and passing the savings through to customers with very low ticket prices. The firm was founded in 1996 as a low cost domestic airline, and was purchased by Tony Fernandes in 2001. The firm was re-launched as a no-frills airline in 2001 with three aircraft. Air Asia entered the low-cost international market in 2003. The firm currently has revenues of $60 billion and provides services to 60 million customers a year. Air Asia is the first low cost airline to have formed a joint venture for the procurement of aircraft with a competitor, JetStar, which is based in Singapore (Quantas, 2010, 1). The airline currently has interlocking ownership through the Shin Corporation which holds a major equity position in b oth Air Asia and Thai Air Asia. The airline also holds a minority equity position of 30% of JetStar, which is a low cost Australian airline. 2.0 Environmental and Industry Analysis A PESTLE analysis provides an assessment of the industry environment, which is necessary to create a context for the airline industry analysis (Grant, 2008 p. 68). A Porters five forces analysis provides an indication of the competitive forces influencing rivalry in the airline industry. 2.1 PESTLE Analysis The PESTLE analysis is a qualitative evaluation of the political, economic, social, technological, legal, and environmental forces affecting the airline industry. The focus of the analysis is on the East Asian region, which is the primary market for Air Asia. Political: The trend is toward liberalisation of the airline markets in East Asia to allow airlines access to markets without the need for a specific bilateral agreement concerning air transportation between nations. An ASEAN open skies agreement, the Roadmap for Integration of Air Travel Services (2004) was ratified by member nations in 2007 and will be fully implemented by 2015. Nations in the region such as India and China that are not members of ASEAN are also liberalising air transportation regulations (OConnell Williams, 2006, p. 362). Economic: The rate of economic growth in the ASEAN nations is variable, with the ASEAN member nations experiencing a growth rate of only 1.5% in 2009 because of the global economic crisis. In contrast Chinas GDP grew at 8.9% in 2009 while Indias GDP grew at 6.8%. Economic growth in 2010 and beyond in the region is likely to be strong because East Asia has largely recovered from the global recession. Social: The social trend in East Asia is towards increased consumption including transportation consumption because of the economic growth in the region. Globalisation has also increased the propensity to travel in East Asia for both business and recreational purposes. The population in the region is also growing rapidly. Another social trend is the increased use of personal computing devices, which intersects with the technology drivers in the airline industry. Technological: The air transportation industry is technology-driven, with information technology used to enhance marketing and engineering technology used to improve safety. Airlines use information technology systems such as internet ticket sales, paperless tickets and automated check in systems to improve customer care while reducing cost of operations (Buhalis OConnor, 2005, p. 12). These systems are also used to maximise load capacity by controlling scheduling and use of aircraft. Legal: The nations in East Asia have various ownership and anti-competition laws that affect the ability of airlines to merge or to acquire an airline (Hsu Chang, 2005, p. 558). In addition some nations in the region have laws that affect the ability and the nature of joint venture agreements between domestic and foreign airlines. Environmental: The PESTLE analysis suggests that the implementation of the Open Skies agreement can increase access to markets for air carriers although the various national laws concerning ownership may hamper the use of a merger and acquisition strategy for expansion. The analysis also suggests that airlines implementing new technologies to improve customer care may enjoy a competitive advantage. The growing population and affluence in the region will produce greater demand for air transportation in the long run. 2.2 Five Forces Analysis The five forces analysis is an industry-based assessment of the factors driving competition to support the development of strategy (Peng, 2009, p. 35) (see Appendix A). If the competition in the industry is high, there is less likelihood that a firm in the industry such as Air Asia will gain competitive advantage through a strategic initiative. Buyer Power: Buyer power in the airline industry is weak because of fragmentation of buyers and the large numbers of potential buyers. The propensity of air travel in East Asia is relatively low compared to the global average of 2.0 trips per year, with India at .1 and China at .3 (OConnell Williams, 2006, p. 362). At the same time, the large size of the East Asian market results in sufficient travel to support a growing airline market. Buyer power is somewhat strengthened by low switching costs in the industry, with buyers able to chose among many different competing airlines. Buyers can be segmented into business travellers and recreational travellers with different price sensitivities. Business travellers value flight schedule and convenience in an airline with price often a secondary consideration. In contrast, recreational travellers are more sensitive to price and the cost of the airfare relative to the total cost of recreation (Talluri van Ryzan, 2004, p. 17). Supplier Power: Suppliers in the airline industry consist of aircraft manufacturers, producers of fuel, and airports, with the power of these groups moderate. The manufacturers of aircraft have moderate bargaining power because of the high cost to airlines for switching aircraft types because of the need to carry additional parts inventory. Aircraft manufacturers, however, pose no threat of credible integration. The producers of fuel have relatively strong bargaining power because oil prices are established by global markets with airline consumption representing only a small portion of oil industry sales. Airports have moderate bargaining power through their ability to provide airlines with gates and ground services. Although airlines changing airports in a destination region face high switching costs, the increased development of regional airports intended to reduce congestion at major airports reduces the bargaining power of airports because of gate fee competition (Hooper, 2002, p . 293). Threat of Substitutes: The threat of substitutes is high in domestic markets because consumers in East Asia prefer rail and road transportation that is less expensive than air travel whenever possible despite the increase in time for travel (OConnell Williams, 2006, p. 362). The threat of substitutes in international travel within the region is low because of the absence of viable substitutes. Overall, the threat of substitutes in the industry is moderate. Threat of Entry: The threat of entry is high in the industry. Although the cost of aircraft is high, a new firm can enter the market with only a few aircraft as Air Asia did in 2001. The liberalisation of the market environment is eliminating barriers to entry in the form of governmental restrictions on airline routes. As a result, a threat of entry also exists from established airlines from other regions seeking to expand routes in the East Asian region. Competitive Rivalry: Competitive rivalry is high in the industry because of a diversity of rivals, high cost of fixed assets and operations, low switching costs, and low levels of product differentiation. Many airlines compete in the East Asian market, each of which has different strategies and different brand reputations. As a result, price rivalry is characteristic of the industry. Aircraft are expensive to purchase and operate, with a high load capacity necessary to cover costs. Passengers can switch airlines at a relatively low cost despite the use of incentive programmes by some airlines to increase customer loyalty. While air transportation can be differentiated based on the level of amenities available to passengers, the fundamental attribute of transportation service is similar in all airlines. The five forces analysis suggests that the primary threat in the industry comes from competition among rivals, which is intensified by the possibility that new airlines will enter the East Asian markets. The analysis also suggests that opportunities may exist for smaller airlines to form strategic partnerships with other airlines to expand the schedule and destination options for passengers at a cost less than the amount necessary for direct investment in aircraft and terminal gate facilities. In the low cost segment of the industry, taking advantage of this opportunity would require Air Asia to adopt a strategy that restructured in the industry (Cockburn, Henderson, Stern, 2000, p. 1127). 2.3 Competitors and Competitor Groups Competitors in the airline industry can be divided into the two main groups of full service airlines and low cost airlines. Full service airlines are large firms that have been in the industry for an extended period of time, with many of these airlines enjoying a monopoly or quasi monopoly on certain national routes prior to the gradual liberalisation of the airline industry in the ASEAN market, with full liberalisation taking place by 2015. These major airlines often use a hub-and-spoke routing system in which short-haul feeder flights bring passengers to a hub airport for transfer to other aircraft for long-haul flights or for other short-haul flights to reach their final destination (Burghouwt and Veldhuis, 2006, p. 107). Airlines in this competitor group use a differentiation generic strategy based on frequent flight scheduling and use of airports conveniently located with respect to major urban centres, with a wider range of services justifying higher ticket prices. They also ha ve a wider range of destinations including transcontinental flights. Competitors in this group include Singapore Airlines, Air China, Malaysian Air, and Thai Airways International. The low cost group of competitors focus on flights taking passengers directly from the point of origin to their final destination, although transfers may be necessary to consolidate passengers and maximize capacity utilisation. Airlines in this competitor group are regional airlines with destinations limited to East Asia. There are numerous competitors in this group including Jet Star, Tiger, Value Air, Firefly, and Maswings. Appendix B shows the positioning of firms in the two competitor groups. 2.4 Developmental Stage of Market and Industry The air transportation market in the East Asian region is in the growth stage of development, which is characterised by a rapid rate of increase in sales (Inglada, Rey, Cote-Millan, 2006, p. 9). The economic growth in the region is allowing more individuals to afford air transportation, particularly for tourism. In addition, the increased commerce with the ASEAN region and with China as a result of the ASEAN Free Trade Agreement that was gradually implemented between 2004 and 2010 is producing higher commercial and business demand for air transportation between Southeast Asia and China (Wong Chan, 2004, p. 509). The low cost segment of the airline industry in East Asia can be viewed as at the point of emerging from the market penetration phase of growth. The low cost airline industry is comparatively new in East Asia, with independent airlines entering this market segment in 2001 (OConnell Williams, 2005, p. 260). Many of the firms in this segment of the industry can be considered prospectors using the Miles and Snow typology because they adopt strategies to use entrepreneurial skills for developing new types of services and have strong marketing competencies (Wratschko, 2009, p. 71). In contrast, the major air carrier segment of the industry can be considered mature, but undergoing a period of transformation because of the elimination to governmental regulations that had given many of these airlines a competitive advantage in routes and airport access. These airlines can be considered as defenders because they focus on retaining market share despite the instability in the market created by new market entrants such as low-cost airlines. 3.0 Resources and Capabilities In the resource-based theory of the firm, the resources and capabilities of the firm should be the foundation of the firms strategy. To use this approach, the firm assesses its resources, determines the capabilities that can provide it with competitive advantage, select a strategy that matches resources and capabilities with opportunities, and identify resource gaps that have to be filled (Grant, 1991, p. 115). A SWOT analysis can be used to identify the resources and capabilities of Air Asia and the way the firm can use these resources to take advantage of opportunities and counter threats (see Appendix C). A value chain analysis can provide an assessment of the areas in which Air Asia can add the most value for customers, which a gap analysis identifies the resources that Air Asia must acquire to implement a selected strategies. 3.1 Swot Analysis Strengths: Air Asia has a strong management team, with operations managed by an ex-Ryanair director with extensive experience in controlling expenses in a low cost airline (OConnell Williams, 2005, p. 264). The airline has a good technology infrastructure that supports very low cost of operations from its use of technology to automate customer processing and to maximise load on flights. The company also has strengths in operational cost containment through very low staff levels, lack of amenities on flights, and standardisation of aircraft which reduces expense for maintenance and parts inventory. Only 8% of the airlines passengers are business travellers, indicating that the cost leadership strategy has been successful in attracting the recreation segment of the market (OConnell Williams, 2005, p. 268). Another strength of the firm is its marketing competency, which has effectively designed and promoted a service targeted to the underserved low-cost no frills segment of the market . The airline has a breakeven load factor of only 52% and the worlds lowest airline unit cost of $.23 per passenger kilometre (OConnell Williams, 2005, p. 265). The airline also has a strong brand reputation in the market for offering low fares. The airline also has strong information technology competencies. Weaknesses: Air Asia has weaknesses in human resources, poor customer care in resolving complaints, and limited ability to attract business travellers. Because of its low cost approach to operations, the airline has lower staff levels than competitors. The lower staffing creates issues such as delays in turnaround time that result in delays in departures, with inadequate communications and support for delayed passengers. The airlines business model also reduces its ability to attract the business market that values flight scheduling, on time flights, and convenience. Air Asia uses only the A320 aircraft, which has a range of only 4,800 km with a full passenger load, which limits the destinations that the airline can serve (Airbus, 2010). Opportunities: Opportunities for Air Asia are providing expanded service in the growing East Asian airline market, opening new intercontinental routes, and forming joint ventures or other strategic alliances with competitors in markets not currently served by the airline. A significant overlooked opportunity in the region is the potential of tourism from Northeast Asia to Southeast Asia (Winter, 2007, p. 28). Smaller airlines can gain greater access to markets in the region through joint ventures and strategic alliances that allows airlines to code share, which involves transporting passengers using aircraft from two or more airlines. Threats: The primary threat for Air Asia is an increase in competition with some airlines adopting a similar operating model to Air Asia which reduces differentiation. A threat to the business model comes from cultural differences such as the preference of Indonesians to use heavy luggage that must be stowed in cargo compartments (The Low Cost, 2009). Another threat comes from the regulations in some nations setting minimum fares and airport usage limitations, which are not covered by the ASEAN Open Skies agreement. The airline is vulnerable to the threat of an increase in fuel prices and the possibility of disruptions to travel caused by terrorist attacks. The SWOT analysis indicates that Air Asias strengths in management, operational efficiency, marketing, and brand reputation would allow it to take advantage of the opportunities presented in the region from growth and tourism potential. These strengths could also support efforts to develop more intercontinental routes and joint ventures with competitors. The weaknesses of the airline in limited human resources and poor customer care could inhibit growth unless they are addressed. The weakness of insufficient staffing increases the firms vulnerability to the effect of cultural differences. At the same time, the firms strengths can help overcome the threats posed by increased competition. The airlines difficulty with attracting business passengers because of its business model may ultimately have a negative effect on its market share as business travel in the region increases. 3.3 Value Chain Analysis The value chain analysis disaggregates the activities of the firm to determine which activities add the most value to customers (Grant, 2008, p. 145). The inbound logistics segment of the chain involves purchase or leasing of aircraft, fuel, and gate space at airports, which add some value through reducing overhead and by providing convenient or desirable routes. The airline adds significant value to the customer in its operations, which has reduced costs to allow the fares to be the lowest in the world. This segment of the value chain, however, does not add value for customers who desire amenities or assistance from airline staff because of insufficient support from the human resources management function. Outbound logistics in the context of an airline involves factors such as airport turnaround time, which are related to operations. Marketing and sales also adds significant value to operations by the airlines ability to leverage its technology support function for internet ticket sales, paperless tickets and automated check-in. Because of the difficulties that the firm has with customer care and complaints, the after sales service segment reduces value for the customer. Based on this analysis, Air Asia adds primary value for customers in the operational and marketing segments of the value chain. 3.3 Gap Analysis Gap analysis involves determining the discrepancies between the current resources of the firm and the resources necessary to achieve the desired future state (Grant, 2008, p. 162). The generic future state for Air Asia is continued growth in its primary market in East Asia and expansion into secondary markets. To increase its share of the market in East Asia, Air Asia requires additional aircraft, additional staff, and additional access to airport gates. The airline has 78 planes available including aircraft owned by the firm and aircraft available through joint ventures, all of which are A320 models. Because these planes operate near capacity, additional aircraft would have to be acquired for expansion. To expand into intercontinental markets, the airline would also need larger aircraft with longer range. The firm would also require additional human resources to meet the operational and customer care needs with expansion, particularly to attract business customers. The analysis sugg ests that the firm does not have sufficient depth and breadth of resources to support expansion and must acquire additional resources. 3.4 Technical and Landscape Fitness of Air Asia Air Asia has high technical fitness, but only moderately high landscape fitness. Air Asia has developed and implemented a proprietary yield management system, computer reservation system, and enterprise resource planning system. In addition, the firm makes extensive use of a front-end internet interface with its backend computer systems to support online internet ticket purchases and paperless tickets. The technology systems are flexible enough to respond to any change in customer requirements, and have been a factor in promoting the acceptance of paperless tickets in Malaysia (Sulaiman, Ng, Mohezar, 2008, p. 149). Air Asia has been successful in attracting the low-cost segment of the market, but may not have sufficient flexibility to respond to a change in the environment such as a surge in business demand or a dramatic decrease in demand because of terrorist attack or high fuel prices. 3.5 Competitive Scenarios A likely competitive scenario is an increase in competition in the low cost segment of the East Asian airline market from new entrants and low cost subsidiaries of established major carriers. A FAR analysis of the scenario suggests that other carriers will adopt some of the functions used by Air Asia such as paperless ticketing, reduced staff level, and no amenities to become cost competitive. The assets required for these airlines to adopt this business model are generally available with their existing fleets of medium range aircraft. The risk posed by this scenario is Air Asias loss of competitive positioning as the lowest cost carrier in the market. 4.0 Conclusion The most likely reason for Air Asias success has been its willingness to risk using innovative strategies to reduce costs while maintaining profitability. The firm was a pioneer in the use of internet reservation and paperless tickets in the market, with its marketing overcoming any passenger reluctance to use the electronic systems. It has also adopted the innovative strategy in the low cost segment of the market of forming joint ventures with competitors to gain entry into new markets and to reduce operational costs. 4.1 Recommendations Air Asia should expand into the intercontinental market by using Abu Dhabi as a hub for routes in western Asia, North Africa, and Europe. From the Abu Dhabi hub, the airline could offer flights to India and Southeast Asia. The business model would continue to follow the cost leadership generic strategy. To implement this strategy, the airline would have to expand the size of its fleet, with the possibility of adding some wide body aircraft designed for long haul flights in addition to A320s. Funding could be obtained from a seasoned equity offering, with the airlines historic performance supporting the offering. The airline could also form code sharing relationships with low cost airlines in Europe and western Asia. This strategy would offset some of the airlines vulnerability from additional competitors using a low cost business model entering the East Asian market. Air Asia should offer some flights designated as business class that provide a wider range of services for business travellers at a higher price than its normal flights. This strategy would be intended to attract a higher percentage of business travellers. Implementing this strategy would require modified A320s to provide passengers with additional seating space and may require additional staff for customer care. The business class aircraft would have priority in operations for scheduling and turnaround to ensure that they remained on time. The airline would use its marketing competencies to differentiate between low cost fares and business class fares. This strategy would address the problem of low market share in the business segment of the market and diversify the market base if competition in the low cost segment increases.

Free Essay on Nathaniel Hawthornes Scarlet Letter - The Character of Pearl :: Scarlet Letter essays
The Character of Pearl in The Scarlet Letter One of the most complex and elaborate characters in The Scarlet Letter is Pearl, the daughter of Hester Prynne and Arthur Dimmesdale. Pearl, throughout the story, develops into a dynamic individual, as well as an extremely important symbol. Pearl is shunned because of her mother's sin. Pearl is a living representation of the scarlet letter - acting as a constant reminder of Hester's sin. Hawthorne uses vivid descriptions to characterize Pearl. She is first described as the infant; "...whose innocent life had sprung, by the inscrutable decree of Providence, a lovely and immortal flower, out of the rank luxuriance of a guilty passion." (81). From the beginning of her life she is viewed as the product of a sin, as a punishment. Physically, Pearl has a "beauty that became every day more brilliant, and the intelligence that threw its quivering sunshine over the tiny features of this child." (81-82). Pearl is ravishing, with "beauty that shone with deep and vivid tints' a bright complexion, eyes possessing intensity both of depth and glow, and hair already of a deep, glossy brown, and which, in after years, would be nearly akin to black." Combining with her extreme beauty, are the lavish dresses that she wears. The exquisite dresses and her beauty cause her to be viewed as even stranger from the other typical Puritan children, whom are dressed in traditional clothing. As a result, she is accepted by nature and animals, and ostracized by the other Puritan children. "Pearl was a born outcast of the infantile world... the whole peculiarity, in short, of her position in respect to other children." (86). Pearl was not accepted by the children; her unavoidable seclusion was due to the sin of her mother. On the rare occasion that the children would show interest in Pearl she would "grow positively terrible in her puny wrath, snatching up stones to fling at them..." (87) As a result of Pearl's seclusion from society nature sympathizes with Pearl, which can be seen with the role of the sunshine in the forest. "The light lingered about the lonely child, as if glad of such a playmate," (168). The sunshine is grateful for Pearl, accepting her as an equal. Hawthorne describes another sign of acceptance as the "great black forest...became the playmate of the lonely infant." (187).

Nazism Theme in the Antz Movie
In the movie Antz, there were a variety of types of governments shown. The main one demonstrated by General Mandible, was fascism or also known as nazism. General Mandible uses his army to make the other ants in the colony behave. There are many different situations shown in this movie to prove that General Mandible uses Fascism or Nazism in this movie. Whereas, on the other hand, Z wants a direct democracy. He wants everyone to say what they have to say and treats everyone evenly. The first reason showing that General Mandible is using a fascism or nazism is that he does not care about every individual ant; he only cares about his colony. He does not care about what any ant has to say and whatever he says, that is what is going to happen.Whereas Z says that everyone should speak out. Also everyone is the same. In the movie, Z says that everyone should think for themselves and that. There are also many other places where General Mandible demonstrates a Nazism or a fascism type of gov ernment is that he imprisoned people when they did not so anything wrong. An example of this was when Z ran away and General Mandible imprisoned Weaver. Since Weaver did not do anything wrong, General Mandible should not have been allowed is imprison him. Z on the other hand wants the colony to be run as a democracy. As the colony was making a ladder, Z says that we are a colony, implying that everyone is just as important to one another. Also in the end when everyone gets up safely, he says that we did it, not I did it. There were many other types of governments shown in this movie as well but these two showed the major two in the movie. Even though Z did not use the direct democracy, it is what he wanted to be used and it is what would have been used if Z had been the leader.

I Am Sam Film Analysis Essay
Sam is an intellectually disabled man whose place in society is questioned regularly as many members of society look down on him as a person and a parent, judging him and alienating him and showing him that he doesnââ¬â¢t belong. These opinions are strengthened in a scene where Samââ¬â¢s daily routine is partially altered when he takes Lucy to Big Boy instead of IHOP and is unable to get his usual order; he has a mental break down and this reaction from the slight change only reinforces to the rest of society that as a mentally disabled man, Sam doesnââ¬â¢t belong as a regular part of society. As a director of the film, Nelson uses different colours as a technique to convey emotion and create the feeling of belonging or not belonging. When Sam and Lucy are together the colours are bright which creates a warm, welcoming atmosphere showing that he belongs. Although in contrary scenes where he wishes to make it seem as though Sam doesnââ¬â¢t belong, such as in the courtroom scenes where Lucy, the one person who makes him feel as though he belongs is taken from him, he creates a sad and dark atmosphere turning the colours dark and this to be more emotional. Background music is used to control the mood and atmosphere of the film and is used as an instrument to represent the sense of belonging and not belonging Sam feels. This technique is shown in the beginning of the film when Samââ¬â¢s routine has to change and he rushes to hospital in order to see the birth of his daughter, the music is turned to a frantic percussion beat representing the feeling of stress and desperate nature of the situation he is in. Throughout the movie this quick pace percussion beat continuous emphasising the stress for Sam in particular scenes when he feels stressed or as though he doesnââ¬â¢t belong, like at the time when he realises Lucy is holding back her education because of him in order to make him feel smarter the beat represents his quickening heart rate, which is how Nelson used sound to reinforce mood and atmosphere. Nelson also uses props to show the loving nature of the relationship between Lucy and Sam. A scene where this is depicted is when they are on the swings together at the park, Nelson uses doves, which is a symbol of love, flying across the sky above them at the beginning of the scene in a birds-eye view camera shot which symbolizes the everlasting love between them. Another camera technique used to convey love between Lucy and Sam is conveyed when the camera zooms in on Sam and Lucy who are holding hands showing that despite his intellectual incapability she accepts and loves her fath er regardless.

Tort law Essay Example | Topics and Well Written Essays - 1750 words
Tort law - Essay Example However, contact is the basic element of battery. Since contact is an essential element of battery, there must be an absence of contact for an assault. In other words loosing battery comes under the ambit of an assault2. As per the law of UK both the offenses can be booked under criminal and law of tort. Therefore, anyone who found guilty under the offenses is liable for prosecution under the criminal and civil law. Under the criminal law assault is an attempt to commit a battery one some oneââ¬â¢s body3. Intention or motive behind an offense is necessary. The defendant or the attacker must have intention or motive to harm someone bodily. Assault and battery have two motives a) one in retaliation and b) in self defense. The intention or motive involved in assault and battery should appear on the body of the aggrieved person. If there is no intention or motive of a person to bodily harm another person, legally cannot be considered guilty of offenses as mentioned hereinabove4. Conse nt In all civilized states, consent is used in defense of civil assault and battery by the offenders. However, combating with mutual consensus does not deprive anybody of his or her legal right to sue. However, there is difference of opinion amongst the jurists whether the criminal assault or battery can be used in defense of any person. ... Self-Defense A commonly used term wherein a person can use a certain degree of force to save himself from bodily injuries inflicted upon by another person. Now it is up to jury to determine whether the degree of force used in self defense is valid and permissible under the law. If a man by his or her own will initiate fight without justified reasons against another person cannot be treated such fight in self dense. Here, the intention and motive of a person does matter6. As far as the use of force against the offender with an object to save himself or herself in retaliation of an aggressorââ¬â¢s attempt is justifiable under the law. In all the countries around the globe, a defender can use deadly weapon to save his or her life provided his or her life is in danger. In majority states, law provides support to a person who may stand in front of an aggressor to defend himself although the chances of safe escape from the scene are there7. The court will examine the degree of force use d by the defender against the offender under the circumstances was justified or not. The following factors should be taken into account by the jury while deciding the matter a) age b) size and c) strength of participants8. Defense of Others Helping out others in their turmoil or in case of need treated valid defense provided the defender was not at fault. In case of defending others, the defenderââ¬â¢s right to claim self defense of a protected person cannot be undermined. In few cases the defender reasonably believes that he or she was in need of help to come out of the worst scenario9. The law of tort treats the assault and battery an attack on the security and safety of a person life hence the wrong done to the victims attracts compensation for the damages. Under the civil law, the

Freud on Oedipus Essay Example | Topics and Well Written Essays - 500 words
Freud on Oedipus - Essay Example The Oedipal complex as described by Freud indicates men wished to possess their mothers in much the same way that their fathers did. ââ¬Å"It is the fate of all of is, perhaps, to direct our first sexual impulse towards our mother and our first hatred and our first murderous wish against our fatherâ⬠(Freud, 2006). According to Freudââ¬â¢s theory, in identifying with the male gender, boys begin to see their fathers as competition and begin wishing they could replace their fathers and marry their mothers. Freudââ¬â¢s theory held that children suffering the guilt and frustration of the oedipal complex, in which the child unconsciously desires an intimate relationship with the parent of the opposite sex and the removal of the parent of the same sex, who are incapable of solving this conflict on their own eventually grow up to become criminals as they seek alleviation from this guilt through punishment. To illustrate his point, he continuously goes back to the story of Oedipu s to illustrate these ideas. In the play, Oedipus is fated at birth to grow up to kill his father and marry his mother, so his natural father orders that he be abandoned to the wilderness expecting that he will die of exposure to the elements. However, the crying baby was rescued by a shepherd and taken to the neighboring monarchs, who were sadly childless, to be raised as their son. All of this history was unknown to Oedipus when he took leave of his parents at an appropriate age to go question the Oracle about his future. As he is leaving the Oracle, Laius, seeking a solution to a Sphinx problem back in Thebes, is approaching. The two come together at a place where three roads meet and they argue over who has the right of way. Their argument turns into a fight and Oedipus kills Laius never knowing who he really is, thus fulfilling the first part of the prophecy without even knowing it. Because he is

Who are you Essay Example | Topics and Well Written Essays - 500 words - 1
Who are you - Essay Example le, I have a passion for the study of history, something that is very rare today considering that most of my friends consider history to be a boring subject. I am kind of a loner because except for my family, I have very few friends and in fact, I find it very difficult to make new friends. I like to study politics, again a subject that most of the people I know find to be boring or a waste of time but I think that it is a very relevant thing to study so that we can know what exactly is happening in our society, because these two cannot be separated. Some parts of me that have changed over time while there are others, which have remained the same since childhood. I was raised in a very conservative family whose values were instilled in me from an early age. However, as I have grown older, I have come to realize that some of the values which I was brought up to believe in are very discriminatory towards people of other cultures and that is why I strive to study other people and their cultures in order to better understand them. In other aspects, I have remained the same considering that I am still proud of my country, as well as the community within which I grew and most of all, I am still very close to my family and friends. I value my body a lot and in fact, many religions state that the body is a very holy thing (Angel, 141 ââ¬â 156). I believe that it is our duty to take very good care of it because it is the vessel in, which our souls are carried. I exercise regularly and have a well balanced diet to ensure that my body remains healthy because if I were to do otherwise, then it is certain that my body would deteriorate quickly. I would like to live a long life and the best way to achieve this would be to maintain my body at the best standard I possibly can. There are many ways through, which I have come to know other people and many of these vary. The first people I have come to know are my family; this is because they are the people I first interacted with

ACL Injury Research Paper Example | Topics and Well Written Essays - 2000 words
ACL Injury - Research Paper Example There are other knee ligaments injuries but the most common injury associated with instability at the knee is ACL injury (Chaudhari, 2008). Perhaps this is because of the fact that ACL injury presents quite a number of ways through which it can suffer tears. Research has shown that the most common ACL injury occurs when the knee is bent exceedingly to the or to the sides more than it is used. Such scenarios are highly likely to occur amongst sports persons during trainings when they engage in activities aimed at making them flexible. In other instances, ACL injury may also occur when there is a direct pressure exerted on the thigh at a time when a person is standing on one leg (Tiidus, 2008). Studies have also revealed that ACL injury may also occur when a victim makes abrupt stop from a significantly highly speed, or attempts to make a sudden turn to the side while on a significantly high-speed motion. In all the above instances, one may observe that they all tend to exert pressure to the sides or on the ligaments at the back of the leg as had been noted. It is not a straightaway guarantee that any of such movements will result in ACL injury, but that they put a person at a highly risk of suffering from ACL injury. Therefore, there is a need to advise persons that take part in physical activities quite often on how what precautions to take during active periods of activities (Chaudhari et al., 2008). However, many physiotherapists and health professions have researched and proposed various ways for recovery and rehabilitation for detected cases of ACL injury. The thesis statement of this research shall be: Appropriate response to ACL injury should be case specific rather than universal approach for recovery and rehabilitation. This research shall assess various cases and analyze each depending on its magnitude. This is because prevalence of ACL injury has revealed that each case

Managing Teams Research Paper Example | Topics and Well Written Essays - 2250 words
Managing Teams - Research Paper Example Apart from all this factors, the leader of the team is an important and powerful determinant of the success of the team. A leader who is openly cynical, ineffectual, apathetic and interpersonally hostile is less likely to maintain a positive, forward-looking team. A team leader belongs to a team and operates within it. He takes the responsibility of providing vision and mission to the team and sometimes also, represents the whole team to the organization. The main responsibility of the team leader is to ensure that the team is functioning well and also, acts as an involved member of the team (Hayes, 2002). This paper mainly focuses on the importance of teamwork in working environment, leadership and ways of building a leading and effective team. Teamwork in a work environment The use of the concepts like, workgroups and team, within the organization has increased rapidly in the Western Industrialized world. The rise of quality circles and dominance of self- managed teams has come to exemplify this movement throughout the work organizations. These concepts have gained importance due to the lack of customized form of work and flexibility, which have reduced the competitive ability. Teamwork has been introduced in the organizations for effective recruitment and better utilization of the employees in order to achieve organizational goals. Team work has also helped the employees in accomplishing their need by controlling the work environment (Doorewaard, van Hootegem & Huys, 2002). It is not unheard that a successful teamwork influences the success of a business. Kets De Vries (1999) has emphasized on the fact that research has proved that effective teamwork is one of the fundamental elements that facilitates a high performing business. The business that continues to perform successfully is largely dependent on teamwork as it is a significant basis for day to day operations. Increased employee morale, effective and efficient communication, flat management structure, client focus, quality enhancement and productivity are the main aspects of team-oriented business. Research scholars have indicated that many of the organizations described themselves as highly team-oriented but in reality, they need to create team-oriented culture within their organization to gain success. Creating an effective teamwork environment depends on flexibility of the organization, leadership styles and management structure. Scarnati (2001) has proposed that employees are less likely to work in a team unless the purpose, condition, arrangement and structure of the firm support their team effort. Once the team gets established, it is not only the responsibility of the management to nurture the effectiveness and efficiency of the working team, but is also the responsibility of the team members to perpetuate the success of the team. The managers are required to select and employ highly skilled individuals who can contribute to the teamsââ¬â¢ environment and lead it to su ccess. Teams are a strategic practice of the management to conduct their business in order to provide flexibility to their employees, under a certain work structure. These individuals are expected to make informed decision within the team, take responsibility
